{"id":2243,"date":"2021-04-21T20:21:08","date_gmt":"2021-04-21T20:21:08","guid":{"rendered":"https:\/\/www.homeinsuranceking.com\/blog\/?p=2243"},"modified":"2021-04-21T20:21:10","modified_gmt":"2021-04-21T20:21:10","slug":"home-insurance-related-lawsuits-in-florida","status":"publish","type":"post","link":"https:\/\/www.gethomeinsurancequotes.com\/blog\/home-insurance-related-lawsuits-in-florida\/","title":{"rendered":"Home Insurance Related lawsuits in Florida"},"content":{"rendered":"\n<div class=\"wp-block-image\"><figure class=\"alignright\"><img loading=\"lazy\" decoding=\"async\" width=\"234\" height=\"187\" src=\"https:\/\/www.gethomeinsurancequotes.com\/blog\/wp-content\/uploads\/2021\/04\/florida-office-insurance-regulation.png\" alt=\"\" class=\"wp-image-2244\"\/><\/figure><\/div>\n\n\n\n<p>In a recent open letter from Florida Insurance Commissioner David Altmaier to House Commerce Committee Chair Representative Blaise Ingoglia, Altmaier detailed the fact that Florida accounts for almost three-quarters of all insurance lawsuits filed by homeowners against insurance companies in the United States.<\/p>\n\n\n\n<p>Altmaier revealed in his letter that the <a rel=\"noreferrer noopener\" aria-label=\"Florida Office of Insurance Regulation (opens in a new tab)\" href=\"https:\/\/www.floir.com\" target=\"_blank\">Florida Office of Insurance Regulation<\/a> (OIR) had gathered data from the <a href=\"https:\/\/content.naic.org\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"National Association of Insurance Commissioners (opens in a new tab)\">National Association of Insurance Commissioners<\/a> (NAIC) Market Conduct Annual Statement (MCAS) Data Call, in an effort to clarify litigation trends in the state\u2019s insurance market.<\/p>\n\n\n\n<p>According to the data, <a href=\"https:\/\/www.gethomeinsurancequotes.com\/florida\/homeowners-insurance-quotes.php\">Florida<\/a> was responsible for only 8.16% of all homeowners\u2019 insurance lawsuits initiated by insurance companies in 2019. One the other side of the coin, Florida was responsible for a shocking 76.45% of all homeowners\u2019 suits opened against US insurers.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u201cWhile we continue to explore these and other possibilities to explain the disparity, OIR does not have a readily available explanation for Florida\u2019s outlier status other than to simply state that Florida is experiencing far more claims-related litigation than the 47 other reporting states,\u201d said Altmaier in his open letter.<\/p><\/blockquote>\n\n\n\n<p>In addition, the data showed that Florida litigation levels have consistently been higher than other states. He provided a chart in his letter to drive home this point.<\/p>\n\n\n\n<p>Percent of nationwide homeowners\u2019 claims opened in Florida:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>2016:<\/strong>&nbsp;Florida is responsible for 64.43 of all lawsuits<\/li><li><strong>2017:<\/strong>&nbsp;Florida is responsible for 68.07 of all lawsuits<\/li><li><strong>2018:&nbsp;<\/strong>Florida is responsible for 79.91 of all lawsuits<\/li><li><strong>2019:&nbsp;<\/strong>Florida is responsible for 76.45 of all lawsuits<\/li><\/ul>\n\n\n\n<p>The letter also documented the fact that the ratio of suits opened to claims closed without payment is eight times higher than the second-place state. Florida\u2019s rate of 27.75 dwarves second place Connecticut rate of only&nbsp;3.4%.<\/p>\n\n\n\n<p>Altmaier\u2019s letter suggested a number of recommendations to help change Florida\u2019s insurance litigation trends.
